Welcome to Whistler Dine In. These Terms and Conditions govern your subscription to our services and use of our website. By subscribing to our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these terms, you must not subscribe to our services.
1. Subscription Services
Whistler Dine In offers subscription services for free delivery within Whistler, BC, Canada, subject to the terms herein. Our services are available to subscribers within a 10km delivery zone from our operational base.
2. Subscription Term and Renewal
Your subscription term starts on the date of purchase and continues for the period selected during the purchase process. Subscriptions automatically renew at the end of each term for a subsequent term of equal length unless you cancel your subscription in accordance with these Terms and Conditions.
3. Right to Cancel
Whistler Dine In reserves the right, at its sole discretion, to terminate or suspend your subscription at any time without notice or cause. Reasons for termination or suspension may include, but are not limited to, breach of these Terms and Conditions, illegal or fraudulent use of the service, or actions that may cause legal liability or financial loss.
4. Non-refundable Subscription
Your subscription is non-refundable. You shall not be entitled to a refund for any partially used or unused subscription period, except as required by applicable law.
5. Subscription Benefits
Your subscription entitles you to free delivery within the specified 10km delivery zone in Whistler, BC, Canada. Subscription benefits are non-transferable and are only available to the subscriber. Benefits may not be shared or extended to any other individual or entity.
6. Changes to Subscription Benefits
Whistler Dine In reserves the right to change, modify, or eliminate subscription benefits at any time, without prior notice. However, we will endeavor to notify you of significant changes to the benefits associated with your subscription.
7. Account Status
If your subscription expires, is placed on hold, cancelled, or if a payment fails, you will immediately lose access to the subscription benefits. It is your responsibility to ensure that your subscription remains active and that payments are made promptly.
8. Limitation of Liability
Whistler Dine In shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your subscription or use of the subscription services.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
10. Changes to Terms and Conditions
